Welcome all Learners and hope mychildlearning.in will be a great experience to clear your concept of the chapters in the opted subjects on a one-to-one basis.
These Terms and Conditions apply to all users of the MyChild Online Tutoring Portal, including without limitation, all persons who create and/ or make available Content Provider Content on the Portal and users who access the Portal to learn a subject or a skill (referred to as Learners) or users who access the Portal otherwise. These Terms and Conditions along with the Privacy Policy, Refund Policy, and any other terms and conditions, rules, policies, or guidelines included in these Terms and Conditions or Privacy Policy by reference and/or as updated on the Portal or otherwise communicated to you from time to time (including terms and conditions of other third party portals that may be used or accessed for gaining access to the Portal or using the Service from time to time (including terms and conditions of another third party portal that may be used or accessed for gaining access to the Portal or using the Services on the Portal, defines the relationship between you and they shall govern your use of the Portal and the Services (defined below) offered therein. Your access to the Portal is subject to your acceptance of the Portal Terms and such acceptance of the Portal Terms forms a legally binding agreement between you and mychildlearning.in. Hence, please take your time to read the Terms in their entirety.
For customers this Privacy Policy “we” “us” “MyChild Online Tutoring Portal” known as “mychildlearning.in ” is owned, managed, operated and offered by ECLATE LEARNING PRIVATE LIMITED, a company registered in India, having its registered office at B 10/020, Shree Nathji Vihar, Sitapur Road, Lucknow 226020 Uttar- Pradesh, India.
“Services” means MyChild Online Tutoring Platform is an online service platform enabling Content Providers to create and offer content in various formats including without limitation audiovisuals, audio, pre-recorded audiovisuals, live audiovisual, and/or in written form in a diverse range of categories through various modes and means and publish and make available such Content Provider Content to the Learners. MyChild acts as an intermediary between the Content Providers and Learners (in accordance with the Information Technology Act, 2000), or similar legislations and makes available the Content Provider Content to the Learners, including through subscription offerings. Mychild learning.in may also offer, either directly or indirectly (through other third-party platforms), other incidental and ancillary services which may include without limitation question
banks, mock tests, doubt-solving solutions, live videos, contests, scholarships, webinars and events (physical and/or online) and facilitating discussion forums.
MyChild is the registered Trade Mark of ECLATE LEARNING PRIVATE LIMITED. Mychildlearning.in is a website product from ECLATE LEARNING PRIVATE LIMITED.
MyChild Online Tutoring Portal reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes. You can review the most current version of the Terms of Service at any time at Terms of Service.
Violation of any of the terms below will result in the termination of your Account. While MyChild Online Tutoring Portal prohibits such conduct and content on the Service, you understand and agree that MyChild Online Tutoring Portal or mychildlearning.in cannot be responsible for the content posted on the Service and you nonetheless may be exposed to such materials. You agree to use the Service at your own risk.
Account Terms
Subject to the Portal terms, mychildlearning.in hereby grants you a non-exclusive, non-transferable, non- sub-licensable, limited license to access and use the MyChild OnlineTutoring Portal for your own personal, non-commercial and private use on an ‘as is’ basis in accordance with these Terms and Conditions and other Portal terms. Learners’ are responsible for maintaining the confidentiality of your account and password to access the Portal. Your account is personal to you and agrees not to provide any other person with access to the Portal and to restrict to your device to prevent any
unauthorized access to your account. You are responsible for maintaining the security of your account and password. mychildlearning.in cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
Mychildlearning.in shall not be liable for any claims arising from any unauthorized discounts/ offers offered by any person (including any third-party Portal or Content provider), other than mychildlearning.in. You will not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
In order to access the Portal, create, publish and/or view the User-generated Content on the Portal, you will need to use a “Supported/Compatible Device” which means a personal computer, mobile phone, portable media player, or another electronic device that meets the system and compatibility requirements and on which you are authorized to operate the Portal. The Supported/Compatible Devices to access the Portal and/or avail the Services may change from time to time and, in some cases, whether a device is (or remains) a Supported/Compatible Device may depend on software or systems provided or maintained by the device manufacturer or other third parties. Accordingly, devices that are Supported/Compatible Devices at one time may cease to be Supported/Compatible Devices in the future. Thus, kindly make sure that the device that you use is compatible with our system/software to use the Portal and avail of the Services offered therein.
You must be a human. Accounts registered by “bots” or other automated methods are not permitted.
You must provide your legal full name, a valid email address, mobile number and any other information requested in order to complete the signup process.
Your login may only be used by one person – a single login shared by multiple people is not permitted. .
Payment, Refunds, Upgrading, and Downgrading Terms
Payments can be made using the Payment Gateway provided along with the selected subject. Learners can also make direct payments to the Company’s Bank Account after written approval from the company.
The Service is billed in advance on an optional Quarterly/ Half yearly/ Annual basis and is non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account. In order to treat everyone equally, no exceptions will be made. MyChild Online Tutoring Portal is solely authorized to offer discounts/ offers, if any, on the Subscription prices.
All fees are inclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.
For any upgrade or downgrade in plan level, the charges that we provided will be charged at the new rate on your next billing cycle.
Downgrading your Service may cause the loss of Content, features, or capacity of your Account. MyChild Online Tutoring Portal does not accept any liability for such loss.
Cancellation and Termination
You are solely responsible for properly cancelling your account. An email or phone request to cancel your account is not considered cancellation. The Account screen provides a simple no questions asked cancellation link.
If you cancel the Service before the end of your current paid-up month, your cancellation will take effect by the end of your current paid month and you will not be charged again.
The Permission given by mychildlearning.in to access and use the Portal under these Terms and Conditions is subject to the following conditions:
1. You agree not to distribute in any medium any part of the Portal, Content Provider Content or the MyChild Online Tutoring Portal Content (as defined below) without the ECLATE LEARNING PRIVATE LIMITED’s prior written authorization.
2. You agree not to alter or modify any part of the Portal.
3. You agree not to access User-generated Content of any other User through any technology or means other than the User-generated Content you have legitimate access to.
4. You agree not to use the Platform for any of the following commercial uses unless you obtain ECLATE LEARNING PRIVATE LIMITED’s prior written approval:
a. The sale of access to the Portal;
b. The sale of advertising, sponsorships, or promotions placed on or within the Portal or Content Provider Content; or
c. The sale of advertising, sponsorships, or promotions of any third-party page or website.
5. You agree not to use or launch any automated system, including without limitation, “robots,” “spiders,” or “offline readers,” that accesses the Portal in a manner that sends more request messages to our servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser. Notwithstanding the foregoing, MyChildlearning.in grants the operators of public search engines permission to use spiders to copy materials from the Site for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials. Mychildlearning.in reserves the right to revoke these exceptions either generally or in specific cases at any time with or without providing any notice in this regard. You agree not to collect or harvest any personally identifiable information, including account names, from the Portal, nor to use the communication systems provided by Portal, unless otherwise mentioned herein.
6. You may post reviews, comments and other content; send other communications; and submit suggestions, ideas, comments, questions or other information as long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringement of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any other form of spam. In other words, ensure that your conduct on the Portal is in accordance with the Terms and Services.
7. In your use of the Portal, you will, at all times, comply with all applicable laws and regulations.
Mychildlearning.in , in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Service at any time and without prior notice in case of (a) fraudulent, criminal, grossly negligent, willful, or otherwise intentional misconduct, or violation of any law or regulation, in connection with the performance of your obligations hereunder and/or (b) demonstrated usage negatively impacting the performance of the Service and/or (c) breach of the herein Service terms and conditions. Such termination of the Service will result in the deactivation or deletion of your Account or your access to your Account, and the forfeiture and relinquishment of all content in your Account or any other similar action deemed appropriate.
Modifications to the Service and Prices
Prices of all Services, including but not limited to Quarterly/ Half Yearly/ Annual subscription plan fees to the Service and changes if any will be only applicable for future renewals. Such notice may be provided at any time by posting the changes to the Service itself.
MyChild Online Tutoring Portal shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.
Content and Personal Data
You own all content (including Personal Data) inputted by You and Authorized Users for the purpose of using the Services (“Content”) and You are solely responsible for the legality, reliability, integrity, accuracy, and quality of the Content. Mychildlearning.in may suspend or terminate use of Services and this Agreement immediately upon receipt of any notice, which alleges that You and/or Authorized User has used Services for any purpose that violates any local, state, federal, or law of other nations, including but not limited to the posting of information that may violate third party rights, that may defame a third party, that may be obscene or pornographic, that may harass or assault others, that may violate hacking or other criminal regulations, etc. You hereby acknowledge and agree that our performance of this Agreement requires that we process, transmit, and store Personal Data under your documented instructions. We shall process the aforementioned Personal Data for Our own business purposes for as long as it is necessary for relation to the purposes stated above, namely for the duration of the Agreement and until collection of the payments unless the processing is necessary for compliance with a legal obligation by mandatory statutory law or for the establishment, exercise or defence of legal claims.
You hereby acknowledge and agree that we shall process your name and email address to communicate with you for the presentation and promotion of the Services or of new services. You may at any time, free of charge, unsubscribe from such electronic communication, easily by clicking the button “unsubscribe” contained in the electronic communication.
Copyright and Content Ownership
You hereby acknowledge and agree that we also process Personal Data that we collect, when you submit a request for support services or other troubleshooting, including information about the Service, Your Portal and other details related to the support incident, such as authentication information, information about the condition of the Services, and error-tracking files. We process such Personal Data in order to respond to the request and solve the problem eventually reported.
We claim no intellectual property rights over the material you provide to the Service. Your profile and materials uploaded remain yours.
Mychildlearning.in does not pre-screen Content, but mychildlearning.in and its designee have the right (but not the obligation) in their sole discretion to refuse or remove any Content that is available via the Service.
Inappropriate content is considered the posting, uploading, sharing, submitting, or otherwise providing content that: a) Infringes MyChild Online Tutoring Portal or a third party’s intellectual property or other rights, including any copyright, trademark, patent, trade secret, moral rights, privacy rights of publicity, or any other intellectual property right or proprietary or contractual right a) You don’t have the right to submit b) Is deceptive, fraudulent, illegal, obscene, defamatory, libellous, threatening, harmful to minors, pornographic (including child pornography, which we will remove and report to law enforcement, including the National Center for Missing and Exploited Children), indecent, harassing, hateful; encourages illegal or tortious conduct or that is otherwise inappropriate. c) Attacks others based on their race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability, or medical condition d) Contains viruses, bots, worms, scripting exploits, or other similar materials e) Is intended to be inflammatory f) Could otherwise cause damage to mychildlearning.in or any third party.
The look and feels of the Service are copyrighted. You may not duplicate, copy, or reuse any portion of the visual design elements or concepts without express written permission from mychildlearning.in
Content and Conduct
As a Content Provider, your access and use of the Portal may additionally be subject to a separate agreement(s) with mychildlearning.in and shall be collectively governed by the terms of such agreement; the Terms and Conditions, other Portal Terms, and such other terms as may be communicated or agreed with the Content Provider from time to time.
A Content Provider, mychildlearning.in grants you a limited, non-exclusive, non- transferable, non-sub licensable license to access and use the Portal for Your own personal and commercial use in accordance with these Portal Terms and any other agreement(s) that may be executed between you (as a Content Provider) and mychildlearning.in (as applicable). Except as expressly permitted by mychildlearning.in under these Portal Terms or otherwise, in writing to you, You will not reproduce, duplicate, copy, sell, redistribute, create derivative works or otherwise exploit the Portal or any portion of the Portal (including but not limited to any copyrighted material, trademarks, or other proprietary information).
Except as expressly permitted under any of the Portal Terms or otherwise in writing, you will not reproduce, duplicate, copy, sell, redistribute, create derivative works or otherwise exploit the Portal or any portion of the Portal (including but not limited to any copyrighted material, trademarks, or other proprietary information).
As a Content Provider, permission to use and access the Portal comes under the following Terms and Conditions:
1. As a User, you may submit User-generated Content on the Portal. However, you agree that mychildlearning.in does not guarantee any confidentiality with respect to any submitted User-generated Content..
2. You shall be solely responsible for your own User-generated Content and the consequences of submitting and publishing such content on the Portal. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish the User-generated Content that you submit. You further agree that User-generated Content you submit on the MyChild Online Tutoring Portal will not contain third party copyrighted material, or material that is subject to other third-party proprietary rights, unless you have permission from the rightful owner of the material, or you are otherwise legally entitled to post the material and to grant the Portal the necessary license and rights required under the Portal Terms. You shall solely be responsible for all claims in respect of your User-generated Content published on the Portal.
3. For clarity, you retain your ownership rights in your User-generated Content. However, you grant a limited permission to MyChild Online Tutoring Portal to make available the User-generated Content on the Portal.
4. You also confirm that you shall maintain not to host, display, upload, modify, publish, transmit, store, update or share User-generated Content or any information on the Portal which :
a. belongs to another person and to which you do not have any right;
b. is defamatory, obscene, pornographic, invasive of another’s privacy including bodily privacy, insulting or harassing on the basis of gender, libelous, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or otherwise inconsistent with or contrary to the laws in force;
c. is harmful to a child;
d. infringes any patent, trademark, copyright or other proprietary rights of others;
e. violates any law, statue, ordinance or regulation or Portal Terms;
f. deceives or misleads any User about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact;
g. impersonates another person;
h. threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting other nation;
i. contains software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;
j. is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person;
k. False, inaccurate or misleading;
l. obscene or contain pornography;
m. Contain any viruses, trojan horses, worms, cancelbots or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system, data or Personal Information.
5. You shall maintain a conduct on the Portal which shall strictly be in accordance with the said Terms of Services.
6. You agree and confirm that you shall not during your use of the MyChild Online Tutoring Portal at any time post or publish any content, comments or act in any way which will amount to harassment of any other User. If at any given point it comes to MyChild Online Tutoring Portal’s notice that you have engaged in any kind of harassment of other. Users, then in such a case you agree that mychildlearning.in shall have the sole right to suspend/terminate your account with immediate effect and without any notice of such suspension or termination and we also reserve the right in our sole discretion to initiate any legal proceedings against you in such cases.
7. Mychildlearning.in does not endorse any User-generated Content submitted on the Portal by any User, or any opinion, recommendation, or advice expressed therein, and mychildlearning.in expressly disclaims any and all liability in connection with User-generated Content. MyChild Online Tutoring Portal does not permit copyright infringing activities and infringement of intellectual property rights on the Portal, and mychildlearning.in will remove all User-generated Content if properly notified that such User-generated Content infringes on another’s intellectual property rights in line with its obligations as an ‘intermediary’. Mychildlearning.in reserves the right to remove User-generated Content without prior notice if it has reason to believe that the User- generated Content is against these Terms and Conditions
8. Content provider shall not engage in any activity that increases/optimizes the User views on any particular Content Provider; these activities, without limitation, include creating multiple fake accounts as Learners, either by you or through a third-party.
9. You shall not engage in any activity that will negatively impact mychildlearning.in and/or other Users of the Portal, including without limitation, activities that involve screen-recording, screen-casting or downloading on any other device of any Content Provider Content (live or recorded) in any manner that is not directly facilitated as feature within the Portal and/or sharing or otherwise publishing such screen-recorded content on third-party platforms, either for a cost or otherwise. If mychildlearning.in becomes aware of the engagement, either by yourself or through a third-party, in any such activity, then mychildlearning.in may terminate your or such User’s access / Subscription along with termination and removal of access to all downloaded content with a right to initiate appropriate legal action, which will be the sole discretion of mychildlearning.in.
General Conditions
The resolution and quality of the content you receive will depend on a number of factors, including the type of Compatible Device on which you are accessing the Content Provider Content and your bandwidth, which may increase or decrease over the course of your viewing. While we strive to provide you a high-quality viewing experience, we make no guarantee as to the resolution or quality of the content you will see when streaming.
Your use of the Service is at your sole risk. The service is provided on an “as is” and “as available” basis.
Technical support is only provided to paying account holders and is only available via email.
You understand that MyChild Online Tutoring Portal uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.
You must not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with the Service.
You agree not to perform misrepresentation of yourself, or disguising the origin of any content (including by “spoofing”, “phishing”, manipulating headers or other identifiers, impersonating anyone else, or falsely implying any sponsorship or association with MyChild Online Tutoring Portal or any third party).
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission from ECLATE LEARNING PRIVATE LIMITED.
You agree not to violate the privacy of others, including publishing or posting other people’s private and confidential information without their express permission, or collecting or gathering other people’s personal information (including account names or information) from mychildlearning.in
We may, but have no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
We retain the right to contact you from time-to-time via email. You can remove yourself easily from the newsletter lists. You can also request to be removed from all communication emails by contacting our support from MyChild Online Tutoring Portal.
Verbal, physical, written or other abuse (including threats of abuse or retribution) of any MyChild Online Tutoring Portal, employee, member, or officer will result in immediate account termination.
MyChild Online Tutoring Portal won’t allow: (a) compromising the integrity of our systems. This could include probing, scanning, or testing the vulnerability of any system or network that hosts our services. (b) Tampering with, reverse-engineering, or hacking our services, circumventing any security or authentication measures, or attempting to gain unauthorized access to the services, related systems, networks, or data. (c) Modifying, disabling, or compromising the integrity or performance of the services or related systems, network or data. (d) Deciphering any transmissions to or from the servers running the services. (e) Overwhelming or attempting to overwhelm our infrastructure by imposing an unreasonably large load on our systems that consume extraordinary resources (CPUs, memory, disk space, bandwidth, etc.).
You must not upload, post, host, or transmit unsolicited email, SMSs, or “spam” messages.
You must not transmit any worms or viruses or any code of a destructive nature.
You must not use meta-tags or any other “hidden text” including MyChild Online Tutoring Portal or our suppliers’ product names or trademarks.
You must not access or search any part of MyChild Online Tutoring Portal by any means other than our publicly supported interfaces.
MyChild Online Tutoring Portal does not warrant that (i) the service will meet your specific requirements, (ii) the service will be uninterrupted, secure, or error-free, and (iii) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations.
You expressly understand and agree that MyChild Online Tutoring Portal shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) or any other matter relating to the service.
The failure of MyChild Online Tutoring Portal to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and mychildlearning.in and govern your use of the Service, superseding any prior agreements between you and mychildlearning.in (including, but not limited to, any prior versions of the Terms of Service).
mychildlearning.in (in its sole discretion) determines that a user has violated these Terms of Service.
Suggestions
We welcome your comments or suggestions for improving or further developing our solutions or product offerings. However, all rights with regard to intellectual property in any comments, feedback messages, ideas, concepts, graphics, notes, designs, color schemes, suggestions, recommendations, and functionality shall transfer to us (or our affiliated companies) upon receipt. If you are not agreeable to releasing any Intellectual Property for an idea, enhancement, or suggestion to us – please do not send it to us.
We will be entitled to use, reproduce, sell, disclose, publish and distribute any material you submit for any purpose whatsoever without compensating you in any way. For this reason, we request that you do not send us comments that you do not wish to assign to us. We further ask that you do not send any confidential information to us that you do not wish to be kept on record.
We May Transfer This Agreement To Someone Else
Unless otherwise stated in the Terms we provide or agree with you, we may transfer our rights and obligations under these Terms to another organization. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.
Transfer of Business
In the unlikely event that the assets and operations of mychildlearning.in are transferred to another party as a going concern, the personal data mychildlearning.in processes will transfer to that third party in accordance with the Privacy Policy.
Indemnification
You agree to indemnify and hold mychildlearning.in / ECLATE LEARNING PRIVATE LIMITED, its affiliates, officers, clients, agents, employees, contractors, and partners harmless for and against any and all claims, liabilities, damages (actual and consequential), losses, and expenses (including legal fees) arising from or in any way related to any third party claims relating to (a) your use of the Services (including any actions taken by a third party using your account), and (b) your violation of these Terms. In the event of such a claim, suit, or action (“Claim”), we will provide notice of the Claim to the contact information we have for you (provided that failure to deliver such notice shall not eliminate or reduce your indemnification obligations hereunder).
Assignment
You may not assign, delegate, or transfer these Terms or your rights or obligations hereunder, or your Services account, in any way (by operation of law or otherwise) without mychildlearning.in ‘s written consent. We may transfer, assign, or delegate these Terms and our rights and obligations without consent.
Jurisdiction
Please note that these terms of use, their subject matter, and their formation, are governed by Indian law. You and we both agree that the courts of Lucknow, Uttar- Pradesh, India will have exclusive jurisdiction.
Disclaimer
You agree that the portal, content, and all materials are provided on an “as is” and “as available” basis and your use of the portal shall be at your sole risk. To the fullest extent permitted by law, mychildlearning.in, its officers, directors, employees, and agents disclaim and exclude all warranties, express or implied, in connection with the portal and your use thereof.
